By using eSpotly, you agree to these Terms & Conditions. If you do not agree, do not use the app.
02 Service Description
eSpotly is a platform connecting parking owners with drivers in the Philippines. eSpotly is not a party to booking agreements between users.
03 How the App Works
- Owner lists space
- Driver books
- Owner accepts or declines
- Driver pays via PayMongo
- Owner grants access
- Both parties leave reviews after the booking ends
04 User Accounts
Accurate information is required. Owners must complete identity verification before accepting bookings.
All owner accounts are subject to review and approval by the eSpotly team before they are activated. eSpotly verifies the identity documents submitted during registration to confirm authenticity. Accounts that do not pass verification will not be approved.
All space listings submitted by owners are likewise reviewed and approved by the eSpotly team before they are published on the platform. Owners must provide proof of ownership or legal authority over the space (such as a property title, lease agreement, or written authorization from the property owner). A listing only goes live after it passes this review.
05 Owner Obligations
The listed space must be safe, legal, and accurately described. Owners must respond to booking requests and grant access as agreed.
06 Driver Obligations
Use the space only as booked. Respect the property and owner's rules. Drivers are responsible for any damage caused during the booking period.
07 Booking Rules
- A booking is confirmed only after payment is received and the owner accepts
- All bookings and transactions must go through the eSpotly app only. External transactions are not covered by eSpotly protection.
- For daily and monthly bookings, default check-in is 2:00 PM and check-out is 12:00 PM (noon).
- Daily bookings must be for consecutive dates. Non-consecutive dates require separate bookings.
08 Payments & Fees
- All payments processed via PayMongo (GCash, GrabPay, Maya, QR Ph, Card)
- eSpotly charges a 15% platform fee, deducted before owner payout
- Owner payouts run every Friday at 1:00 PM PHT. To qualify, a booking must meet all of the following: (1) Paid — payment from the driver was successfully received; (2) Payout Availability — payments go through a standard processing and settlement period before they become available for payout, this typically takes 3–10 banking days from booking completion depending on the payment method used; and (3) Completed — for hourly bookings, the booking must have ended; for daily and monthly bookings, payment confirmation is sufficient — the booking does not need to end before payout is processed. In all cases, at least 12 hours must have passed since the booking's start date and time. All qualifying bookings are included regardless of when they occurred — there is no weekly cutoff. Any booking that has not yet met the clearing requirement by Friday automatically carries over to the next Friday payout.
- Bank Transfer (PESONet): Payout batches are submitted at 1:00–1:30 PM PHT and credits arrive by 5:00 PM PHT on the same banking day (Monday–Friday, excluding public holidays) if payout is more than ₱50,000. If equal to ₱50,000 or less, InstaPay is used instead (real-time).
- GCash & Maya (InstaPay): Credited in real time once released. Note: InstaPay has a ₱50,000 per-transaction limit — payouts exceeding ₱50,000 will automatically be processed via Bank Transfer (PESONet) instead. Make sure you have a bank account saved in Settings if your earnings may exceed this amount.
09 Cancellation & Refunds
- Cancellation policies vary by listing and are set by the owner
- Bookings are automatically cancelled if the owner does not accept within 4 hours of the driver's booking request
- Bookings are automatically cancelled if the driver does not pay within 2 hours of owner acceptance
- Refunds are approved only for valid reasons: owner did not provide access, spot unavailable or occupied, spot does not match listing (location, condition, or features), double-booking, technical or system error, or other issues investigated and approved by eSpotly support
- Refund requests must be submitted on the same day for same-day and hourly bookings; for multi-day and monthly bookings, report within 24 hours of the issue occurring
- To request a refund, email support@espotly.com with your booking ID and supporting evidence — eSpotly reviews within 24 hours
- Approved refunds are processed within 1–7 banking days
- Refunds are not available for change of mind, late arrival, or non-critical complaints
- eSpotly's 15% commission is also refunded if a refund is approved
- If a refund is approved after the owner has already received their payout, eSpotly will process the refund to the driver and separately reach out to the owner to recover the amount owed to eSpotly
10 Refund Monitoring & Restrictions
- eSpotly monitors driver and owner accounts for unusual refund activity to protect the integrity of the platform.
- 3 or more refunds within 30 days — account flagged for review.
- 5 or more refunds within 60 days — account may face restrictions, suspension, or permanent ban.
- Accounts showing suspicious or fraudulent refund patterns may be investigated and actioned without prior notice.
- eSpotly reserves the right to restrict, suspend, or permanently ban any account found in violation of this policy.
11 User-Generated Content (UGC) Liability
eSpotly is not responsible for user-generated content, including reviews, photos, messages, and listings posted by drivers or owners. Users are solely responsible for their own content. eSpotly reserves the right to remove content that violates laws, contains hate speech, is fraudulent or harmful, infringes copyrights, or otherwise violates these Terms.
12 Chat & Messaging
eSpotly provides in-app messaging between drivers and owners. Chat messages and support data are stored securely for operational and dispute resolution purposes. Do not share personal payment information, passwords, or contact details outside the app.
13 Dispute Resolution & Arbitration
Any disputes between eSpotly, drivers, and owners shall be resolved through binding arbitration under Philippine Arbitration Law, rather than court proceedings. Both parties agree to submit to arbitration as the sole remedy for disputes. eSpotly will mediate in good faith; final decisions are binding.

14 Prohibited Activities
No fraud, harassment, fake identity, bypassing payments, threatening behavior, or illegal activities. eSpotly may suspend or terminate violating accounts without refund.
The following types of spaces are prohibited from being listed on the platform:
- Spaces on public roads, sidewalks, or government-owned property without proper authorization
- Spaces that block fire exits, emergency lanes, or access routes
- Spaces the owner has no legal right to rent out
- Spaces already under exclusive commercial parking management without authorization
- Spaces in restricted zones (military, government-secured, private gated communities) without proper clearance
- Spaces that are unsafe, structurally unsound, or pose a risk to vehicles or persons
- Spaces used or intended for any illegal activity
15 Limitation of Liability
eSpotly is a booking and discovery platform only. eSpotly does not own, operate, or manage any parking space listed on the platform, does not take custody of any vehicle, and has no physical presence at any listed location at any time. All parking services are provided by independent space owners who are not agents of eSpotly.
eSpotly is not liable for any direct, indirect, or incidental damages arising from the use of the platform, including but not limited to vehicle theft, damage, vandalism, towing, accidents, loss of property, or harm to persons occurring at or near a listed parking location — regardless of cause. Drivers park at their sole risk. Damage or theft of a vehicle is the sole responsibility of the vehicle owner.
Drivers are responsible for any damage they cause to a parking space, structures, or surrounding property during their booking period. Owners are responsible for documenting their space before and after each booking. Damage disputes between drivers and owners are private matters — eSpotly may assist in communication but assumes no financial liability.
eSpotly does not guarantee the personal safety of any user at any listed location and is not liable for criminal acts or harm caused by any third party, including parking space owners. Users are advised to exercise personal judgment at all times. In case of emergency, contact the nearest police station or local authorities immediately.
Users assume all risk for their property, vehicles, and personal safety. eSpotly strongly recommends that all drivers maintain comprehensive vehicle insurance.
To the maximum extent permitted by Philippine law, eSpotly — as a booking and discovery platform only — shall have no liability for any damages arising out of or relating to the use of the platform or any booking made through it. Your use of eSpotly is at your sole risk.
16 Intellectual Property
All content, logos, and features are owned by eSpotly. No reproduction without written permission.
17 Privacy & Data Protection
User data is stored securely in compliance with the Philippine Data Privacy Act (PDPA). Core user and transaction data is managed by eSpotly's own backend hosted on Railway. Users have the right to access, correct, or delete their personal data. Contact support@espotly.com — eSpotly will respond within 15 business days of verified requests.
18 Data Security
eSpotly implements industry-standard security measures. In the event of a data breach, eSpotly will notify affected users within 72 hours as required by the PDPA.
19 Modifications
These Terms may be updated at any time. Continued use of the app constitutes acceptance of the revised Terms.
20 Overstay Policy & Account Restrictions
Parking beyond your booked duration is strictly not tolerated. If you need more time, you must create a new booking — do not overstay.
Overstay fees are charged at 3x the owner's hourly rate per hour overstayed.
Repeated violations result in progressive account restrictions:
- 1st offense — warning
- 2nd offense — 3-day account suspension
- 3rd offense — 7-day account suspension
- 4th offense and beyond — permanent ban
Overstay reports must be filed within 4 hours after the booking end time. Reports submitted after this window will not be accepted.
eSpotly enforces these restrictions automatically. Drivers may appeal a permanent ban by contacting support@espotly.com.
eSpotly is not liable for unpaid overstay fees. Account restrictions will be applied to the driver.
21 Governing Law
Governed by the laws of the Republic of the Philippines.
